O risco trabalhista mais acentuado

O risco trabalhista mais acentuado decorre da existência de representantes comerciais, alguns com contrato formal e outros não, tendo em vista a possibilidade de pretender o vínculo empregatício com a empresa Compradora e, por consequência, o pagamento de todas as verbas de natureza salarial não quitadas, além do INSS e FGTS. Caso venha a ser ajuizada ações nesse sentido, caberá a Compradora comprovar que os representantes comerciais não trabalharam na condição de empregado (principalmente subordinados), vez que é pouco provável a possibilidade de negar a existência da prestação de serviços nesses casos.
