RESUMO: É de responsabilidade da União normatizar o regramento do sistema previdenciário para garantir os benefícios previstos. No Brasil, a previdência é dividida em Regime Geral de Previdência Social – RGPS, e os Regimes Próprios de Previdência dos servidores públicos que ocupam cargos efetivos e ainda temos o Regime Complementar de Previdência, que possui caráter facultativo, divergindo dos regimes públicos que são compulsórios. Entre os benefícios concedidos pelos regimes de previdência, está a aposentadoria, que pode ser voluntária ou compulsória, normatizadas na legislação brasileira. Não existe previsão legal para O fenômeno chamado desaposentação, ainda pouco estudado no direito previdenciário e que permite ao segurado já aposentado que desista do benefício e obtenha outro melhor, através de contribuições posteriores ou por mudança de regime previdenciário. Por não possuir previsão legal é negada pelos órgãos administrativos, entretanto já existe jurisprudência envolvendo esses casos. Esse artigo tem por objetivo pesquisar as possibilidades de desaposentação.

Summary: it is the responsibility of regulating the acts of Union pension system to ensure the benefits. In Brazil, the pension plan is divided into General Social Security Scheme-RGPS, and Own private pension schemes of public servants occupying positions and we still have the Supplementary Pension Scheme, which has optional, diverging public schemes which are compulsory. Among the benefits granted by social security schemes, is retirement, which may be voluntary or mandatory, standardized in brazilian legislation. There is no legal provision for the phenomenon called desaposentação, yet little studied in the pension law and that allows the insured already retired to drop this benefit and get another better through subsequent contributions or pension regime change. For not possessing legal provision is denied by administrative bodies, however there is already case law involving those cases. This article aims to research the possibilities of desaposentação.
