SUMMARY: It is the Union's responsibility to regulate the establishment of rules of the social security system to ensure the expected benefits. In Brazil, the pension is divided in the General Social Security Scheme - RGPS, and Regimes of pension of civil servants who hold permanent posts and still have the Supplementary Scheme of Welfare, which has optional, diverging from public schemes that are compulsory . Among the benefits provided by pension schemes is retirement, which can be voluntary or compulsory, standardized by Brazilian law. There is no legal provision for the phenomenon called desaposentação, yet little studied in the social security law, which allows the insured already retired to give up the money and get a better one through subsequent contributions or change pension system. Not having legal provision is denied by administrative bodies, however there is already case law involving such cases. This article aims to research the possibilities of desaposentação.
